Terms of Service

By creating an account or using Simon Platform, you agree to these terms. If you do not agree, do not use the service.

1. Who we are

Simon Platform is operated by D Fabrik, run by Simon Sangla. Contact: simonsangla@gmail.com.

2. The service

Simon Platform provides a hosted web application with authentication and subscription billing. We may change, suspend, or retire features at any time. We try to give reasonable notice for material changes.

3. Accounts

• You must be 16 or older to create an account.
• You are responsible for keeping your credentials and any OAuth sessions secure.
• One account per person. Sharing credentials is not permitted.
• We may suspend or terminate accounts that abuse the service, violate these terms, or disrupt other users.

4. Subscriptions

• Paid plans are billed in advance through Stripe. Prices are displayed on the pricing page and may change with 30 days' notice.
• You may cancel at any time from your account settings. Cancellation takes effect at the end of the current billing period; no pro-rata refunds for partial periods.
• Taxes (VAT/GST) are applied where applicable and shown at checkout.

5. Acceptable use

You agree not to:

• Attempt to access other users' accounts or data.
• Probe, scan, or attack the infrastructure, or circumvent rate limits.
• Use the service to send spam, distribute malware, or host illegal content.
• Reverse engineer or resell the service without permission.

6. Your content

You retain ownership of any content you submit. You grant us a limited licence to store and process it as required to run the service.

7. Warranty and liability

The service is provided "as is". To the maximum extent allowed by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim. We are not liable for indirect, incidental, or consequential damages. Nothing in this clause limits liability that cannot be limited by law.

8. Termination

You may delete your account at any time from account settings. We may terminate or suspend access for material breach of these terms, with notice where feasible.

9. Changes

We may update these terms. We will update the date above and, for material changes, notify signed-in users by email at least 14 days before the change takes effect.

10. Governing law

These terms are governed by the laws of Germany. Disputes will be resolved by the competent courts of Berlin, Germany, without prejudice to any mandatory consumer protections available to you under the law of your residence.
